Terms of service

1. Acceptance
These Terms of Service ("Terms") are a binding agreement between you (or the company you represent) and Tesla Tech, the operator of StatusPulse ("we", "us"). By creating an account, using the service, or configuring a status page on our platform, you agree to these Terms. If you don't agree, don't use the service.
If you're accepting these Terms on behalf of a company, you confirm you have the authority to bind that company.
2. Definitions
- Service — the StatusPulse uptime monitoring and status page platform, including the dashboard, public status pages, notification delivery, and any APIs we publish.
- Account — the authenticated user account used to sign into the service.
- Tenant / Workspace — the organisation-level container that holds your probes, status pages, persons, groups, and settings.
- Probes — checks you configure to periodically query a URL, host, or service.
- Status page — a public page hosted on
statuspulse.ai/<slug>or a custom domain, showing the current status of your probes. - Persons — people you add to your workspace as notification destinations.
- Your content — probe configurations, status page text and branding, person records, and anything else you upload or configure.
3. Accounts
You must provide accurate registration information and keep it current. You are responsible for everything that happens under your account, including any users you invite to your workspace. Keep your credentials confidential and notify us immediately if you suspect unauthorised access.
You must be at least 16 years old, or the legal age of consent in your country, whichever is higher.
4. Plans, fees, and billing
4.1 Plans
We offer a free plan and one or more paid plans. Current plan details — features, limits, and prices — are on the pricing section of our homepage. We may change plan contents and prices with at least 30 days' notice; the new price applies at your next renewal.
4.2 Billing cycle
Paid plans are billed monthly or annually in advance, in Euros (EUR), by the billing method you provided. Annual plans are non-refundable except where required by law; monthly plans can be cancelled at any time and will end at the close of the current billing period.
4.3 Taxes
Prices are exclusive of VAT and other taxes, which are added where applicable. If your jurisdiction requires us to withhold tax, the amount remains your responsibility.
4.4 Usage-based features
Some features (e.g. SMS alerts) are capped per plan (a monthly message allowance). Once the cap is reached in a calendar month, further SMS in that month are skipped and logged. Higher allowances are available by upgrading the plan. Caps reset on the first of each calendar month.
4.5 Failed payment
If a payment fails, we'll retry and notify you. After repeated failed attempts, paid features may be suspended until billing is resolved. Your data is not deleted during suspension.
5. Acceptable use
You agree not to use StatusPulse to:
- Probe services you are not authorised to probe. Only probe your own services, or services whose owners have given consent.
- Run scans at intervals that would constitute a denial-of-service or load-testing campaign against the target.
- Send notifications to people who haven't consented to be contacted for that purpose.
- Host content on your status page (including logos, text, or custom CSS) that is unlawful, infringing, defamatory, hateful, or deceptive.
- Attempt to circumvent plan limits, rate limits, authentication, or security controls.
- Use the service to send spam, phishing, or unsolicited commercial messaging.
- Reverse-engineer, resell, or white-label the service in a way not expressly permitted.
- Upload malware, or probe third-party endpoints with attacks in the request body.
We may suspend or terminate accounts that violate this policy, with reasonable notice where feasible and without notice in cases of active harm.
6. Your content
You retain ownership of your content. You grant us a limited, worldwide, non-exclusive, royalty-free licence to host, store, transmit, and display that content only as needed to provide the service (for example: rendering your status page to visitors, sending your configured alert emails, running your probes).
You are solely responsible for the legality of the content you upload, including any claims it makes, any logos or images you use, and any custom CSS you add to a status page. If someone tells us your content infringes their rights, we may remove it pending resolution.
7. Probe behaviour
StatusPulse sends HTTP requests (and ICMP, TCP, or DNS checks, depending on the probe
type) to the targets you configure, from our probe infrastructure. Our probes
identify themselves with a User-Agent header starting with
StatusPulse-Probe, and the IP ranges we use for checks may be published
on the security page.
You are responsible for configuring check intervals that are appropriate for the target and for ensuring your target is configured to tolerate the probe. A mis-configured probe that overwhelms a third-party service is your responsibility, not ours.
8. Status pages
Status pages are publicly accessible by design. Do not put confidential information into probe names, descriptions, or incident updates that appear on a public status page. Visitor emails collected for status page subscriptions are processed as described in the privacy policy.
9. Notifications sent to third parties
When you add a Person and subscribe them to alerts, you are representing to us that you have a lawful basis to send them those notifications — they are on your team, or they are a customer who has agreed to be alerted, or you have another legitimate relationship that justifies the contact.
If a recipient tells us they did not consent, we may remove them from the account and will let you know. Repeated complaints from recipients may lead to SMS or email features being restricted on your account.
10. Third-party services
Features that integrate with Slack, Microsoft Teams, generic webhooks, Azure Communication Services, or any payment provider depend on those services remaining available. We don't control their uptime or pricing. Where a third-party change forces us to adapt (for example: Office 365 Connectors being retired, carrier registration rules changing for SMS), we'll update the integration as quickly as we can and document the change.
11. Uptime
We target 99.9% monthly uptime for the authenticated dashboard and for the probe engine. Scheduled maintenance (announced in advance) and third-party infrastructure outages are excluded. We do not currently offer a contractual SLA with service credits; if you need one, contact us and we'll discuss a tailored arrangement.
Status pages are served from cached, static-first delivery so that a dashboard outage doesn't take down your customer-visible status page.
12. Privacy and data processing
How we handle personal data is described in the privacy policy; the feature-by-feature mapping to the EU General Data Protection Regulation is on the GDPR compliance page. Where you use StatusPulse to process personal data about your own users or customers (Persons, status page subscribers, probe request bodies), a data processing agreement (DPA) is available on request at privacy@statuspulse.ai and, once signed, forms part of these Terms.
13. Termination
You can cancel your account at any time from the dashboard. On cancellation, paid features end at the close of the current billing period; you retain read-only access to export your data for 30 days, after which the account is deleted unless you reactivate.
We may suspend or terminate your account if you materially violate these Terms, fail to pay after reasonable notice, or use the service in a way that creates legal risk for us or others. Where feasible, we'll give you a chance to cure the issue before terminating.
Sections that by their nature should survive termination — payment obligations, limitations of liability, disclaimers, governing law — do survive.
14. Warranty disclaimer
The service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
Uptime monitoring is a best-effort activity. We don't guarantee that every incident will be detected, that every alert will reach every recipient, or that status pages will always render correctly. Your production on-call process should not rely on a single tool (including ours) as the only signal.
15. Limitation of liability
To the fullest extent permitted by law, our total aggregate liability to you for all claims arising out of or relating to these Terms or the service is limited to the greater of (a) the fees you paid us in the 12 months immediately preceding the event giving rise to the claim, or (b) €100.
We are not liable for indirect, incidental, special, consequential, or exemplary damages — including lost profits, lost revenue, lost data, business interruption, or reputational harm — even if we've been advised of the possibility.
Nothing in these Terms excludes liability that cannot be excluded under applicable law, including for death, personal injury caused by negligence, fraud, or wilful misconduct.
16. Indemnification
You will indemnify us against any third-party claim, damage, or expense arising out of: (a) content you upload (status page content, probe configurations, notifications you trigger); (b) your breach of these Terms; or (c) your misuse of the service. We'll promptly notify you of the claim and let you control the defence, provided any settlement fully releases us.
17. Confidentiality
Information you share with us that is not public (including probe request bodies, custom headers, and API keys embedded in probe configurations) is treated as confidential. Our staff with access to such data have confidentiality obligations.
18. Modifications
We may update these Terms from time to time. Material changes will be announced at least 30 days in advance to the email address on the account. Continued use of the service after the effective date counts as acceptance. If you don't accept the new Terms, your remedy is to cancel your account before the effective date, and we'll pro-rate any unused paid period.
19. Governing law and disputes
These Terms are governed by the laws of Portugal, without regard to conflict-of-laws principles. For disputes that can't be resolved informally, the courts of Lisbon, Portugal have exclusive jurisdiction — subject to any mandatory consumer-protection rights you have under the law of your country of residence.
EU consumers may also use the EU Online Dispute Resolution platform.
20. Miscellaneous
- Entire agreement: these Terms, plus the privacy policy and any signed DPA, form the entire agreement between us about the service.
- Severability: if a clause is unenforceable, the rest stands.
- Assignment: you can't assign these Terms without our consent; we may assign to a successor in a merger, acquisition, or sale of assets.
- Notices: email to the address on the account is valid notice from us to you; email to legal@statuspulse.ai is valid notice to us.
- No waiver: failing to enforce a clause doesn't waive it.
- Force majeure: neither party is liable for events outside reasonable control (natural disasters, war, strikes, internet outages, government action).
